Wild Fit Free retreats include travel, sporting, fitness, wildlife, water-based, outdoor and adventure activities. Participation may involve risks of accident, illness, injury, permanent disability, property loss and, in rare circumstances, death.
By accepting this document, you confirm that:
- You understand the nature of the activities offered during the retreat;
- You understand that some risks cannot be completely removed;
- You voluntarily choose to participate;
- You accept responsibility for risks ordinarily associated with your participation; and
- You agree to the waiver, release and indemnity provisions below, subject to applicable law.
Nothing in this document excludes or limits any liability that cannot lawfully be excluded or limited.
1. About Wild Fit Free
Wild Fit Free, referred to in this document as “WFF,” “we,” “us” or “our,” curates and hosts small-group pickleball, fitness, wellness and adventure retreats.
Retreat services may be provided partly by independent third parties, including accommodation establishments, transport providers, coaches, guides, sporting venues, restaurants, wellness practitioners and activity operators.
2. Activities Covered
This Waiver applies to participation in the WFF retreat and any related activity arranged, facilitated or promoted by WFF.
Depending on the selected retreat and itinerary, activities may include:
- Pickleball coaching, training, matches and tournaments;
- Fitness sessions, stretching and beach workouts;
- Walking, hiking and trail activities;
- Swimming, kayaking, lilo activities and other water-based experiences;
- Horse riding, Segway tours or cycling;
- Canyoning, canopy tours or similar adventure activities;
- Boat trips, sailing and ocean excursions;
- Game drives, safari and wildlife encounters;
- Spa, massage and wellness treatments;
- Road transport and airport transfers;
- Meals, social events and excursions; and
- Free time and optional activities undertaken during the retreat.
The final itinerary may not include every activity listed above.
Some suppliers may require guests to sign an additional activity-specific waiver before participating.
3. Acknowledgement of Risks
I understand that travel and retreat activities may involve ordinary, unusual and unforeseen risks.
These risks may include:
- Slips, trips and falls;
- Muscle strains, sprains, fractures and joint injuries;
- Injuries caused by sporting equipment, balls, paddles or other participants;
- Overexertion, dehydration, exhaustion or heat-related illness;
- Worsening of a pre-existing injury or medical condition;
- Allergic reactions or food-related illness;
- Exposure to sun, wind, rain, cold, heat and changing weather;
- Uneven, wet, rocky or unstable ground;
- Strong currents, waves, tides, cold water or changing sea conditions;
- Drowning or other water-related injury;
- Falls from horses, bicycles, Segways, boats or activity equipment;
- Vehicle accidents, road hazards and transport delays;
- Encounters with wildlife, insects, reptiles, marine life or domestic animals;
- Bites, stings, scratches or allergic reactions;
- Equipment failure;
- Acts or omissions of another guest or independent supplier;
- Delays in reaching medical facilities;
- Limited access to emergency services in certain locations;
- Theft, loss or damage to personal belongings;
- Illness, infection or contagious disease;
- Serious injury, permanent disability or death; and
- Risks that are not reasonably foreseeable at the time of booking.
I understand that this list is illustrative and does not identify every possible risk.
4. Voluntary Participation
My participation in each retreat activity is voluntary.
I understand that:
- I am not required to participate in every scheduled activity;
- I may decline or stop an activity where it is reasonably safe to do so;
- I should not participate if I feel unwell, injured, impaired or uncomfortable;
- WFF or an activity provider may refuse or stop my participation for safety reasons; and
- I remain responsible for making appropriate decisions regarding my own participation.
I accept that not participating in or completing an activity does not automatically entitle me to a refund.
5. Health and Fitness Declaration
I confirm that:
- I am responsible for determining whether I am physically and medically fit to travel and participate;
- I will obtain professional medical advice or clearance where appropriate;
- I have truthfully completed the WFF Medical Disclosure Form;
- I will notify WFF if relevant medical information changes before or during the retreat;
- I will bring sufficient prescribed medication and use it as directed;
- I will inform WFF of relevant allergies, injuries, mobility limitations and emergency considerations;
- I will not participate while affected by alcohol, illegal drugs or medication that makes participation unsafe; and
- I understand that WFF does not provide medical diagnoses or medical advice.
Acceptance of my booking by WFF does not constitute confirmation that I am medically or physically fit to participate.
6. Safety Instructions
I agree to:
- Follow reasonable instructions from WFF representatives, guides, coaches and activity providers;
- Use any required protective or safety equipment;
- Remain within designated areas;
- Inform the relevant person immediately if I feel unsafe, ill or injured;
- Act with reasonable care for my own safety and the safety of others;
- Refrain from reckless or deliberately dangerous behaviour; and
- Comply with activity-provider rules and applicable laws.
I understand that failure to follow safety instructions may result in my exclusion from an activity or removal from the retreat.
7. Personal Responsibility
I accept responsibility for:
- My personal decisions and conduct;
- Participating within my abilities;
- My passport, luggage, sporting equipment, money, electronics and valuables;
- Any medication or personal medical equipment I require;
- Obtaining suitable medical and travel insurance;
- Costs arising from illness, injury, medical treatment, evacuation or repatriation; and
- Damage caused by my intentional, reckless or negligent conduct.
8. Emergency Medical Assistance
If I become ill or injured and cannot give instructions, I authorise WFF and its representatives to take reasonable steps to obtain emergency assistance.
This may include:
- Contacting emergency services;
- Contacting my nominated emergency contact;
- Arranging medical assessment or treatment;
- Sharing relevant medical information with appropriate medical personnel;
- Arranging ambulance, evacuation or other transport; and
- Taking other reasonable action considered necessary to protect my health or safety.
I understand that WFF cannot guarantee the availability, timing or outcome of medical assistance.
I remain responsible for all medical, hospital, medication, evacuation, transport and related expenses incurred on my behalf.
9. Third-Party Providers
I understand that many activities and services are delivered by independent third-party providers.
These providers control their own:
- Staff;
- Equipment;
- Premises;
- Operating procedures;
- Safety systems;
- Scheduling; and
- Terms of participation.
To the extent permitted by law, WFF is not responsible for an independent provider’s acts or omissions where WFF did not cause or control the relevant conduct.
Nothing in this clause removes any responsibility WFF may have under applicable law for its own conduct.
10. Assumption of Risk
Having considered the nature and possible consequences of the risks described in this document, I voluntarily accept the risks ordinarily and reasonably associated with my participation.
I understand that accepting risk does not mean that I waive rights that cannot legally be waived.
11. Release and Limitation of Liability
To the maximum extent permitted by law, I release WFF and its directors, employees, representatives, contractors and agents from claims arising directly from:
- Risks ordinarily associated with activities that I voluntarily undertake;
- My own conduct or failure to follow reasonable instructions;
- A medical condition I failed to disclose;
- Events outside WFF’s reasonable control; or
- The independent acts or omissions of third-party providers that WFF could not reasonably prevent or control.
This release does not apply to:
- Gross negligence;
- Intentional wrongdoing;
- Fraudulent conduct;
- Liability that cannot lawfully be excluded or limited; or
- Rights or remedies that cannot lawfully be waived under South African law.
12. Indemnity
To the maximum extent permitted by law, I indemnify WFF against a claim, loss, damage or reasonable expense arising from:
- My unlawful, intentional, reckless or negligent conduct;
- My material breach of this Waiver, the WFF Terms and Conditions or the Code of Conduct;
- Damage I cause to property;
- Injury I wrongfully cause to another person;
- My failure to follow reasonable safety instructions; or
- Information I knowingly or negligently withheld concerning a material health or safety risk.
This indemnity does not apply to loss caused by WFF’s gross negligence, intentional wrongdoing or other conduct for which liability cannot lawfully be excluded.
13. Personal Property
I understand that WFF is not an insurer of my belongings.
I am responsible for taking reasonable precautions to protect my property, including using available locks or safes and maintaining appropriate travel insurance.
WFF will not be responsible for property that is lost, stolen or damaged unless the loss was caused by conduct for which WFF is legally liable.
14. Travel Insurance
I acknowledge that WFF strongly recommends comprehensive travel insurance.
My insurance should include appropriate cover for:
- Medical treatment;
- Emergency evacuation and repatriation;
- Sporting and adventure activities;
- Trip cancellation and interruption;
- Flight disruption;
- Baggage and personal property; and
- Personal liability.
I understand that I remain responsible for uninsured losses and expenses.
15. Compliance with Other Documents
I agree that this Waiver must be read together with:
- The WFF Terms and Conditions;
- The WFF Cancellation Policy;
- The WFF Privacy Policy;
- The WFF Code of Conduct;
- My Medical Disclosure Form; and
- Any activity-specific waiver required by a supplier.
16. Governing Law
This Waiver is governed by the laws of the Republic of South Africa.
Nothing in this document prevents a consumer from approaching a court, regulator, tribunal, ombud or other body that has jurisdiction under applicable law.
17. Severability
If any provision of this Waiver is held to be invalid or unenforceable, it will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply.
18. Guest Acknowledgement
By accepting this Waiver, I confirm that:
- I have been given an adequate opportunity to read it;
- I understand that retreat activities may cause injury, serious injury, disability or death;
- I understand the nature and potential effect of the risks described;
- I have had the opportunity to ask WFF questions before accepting;
- I voluntarily choose to participate;
- I accept the risks described, subject to my legal rights;
- The information I have provided is accurate and complete; and
- I agree to be bound by this Waiver to the extent permitted by law.
